At FlowState Divers, we are committed to delivering safe, enjoyable, and high-quality scuba diving experiences.
This Cancellation and Refund Policy applies to all services provided by FlowState Divers, including but not limited to:
- Recreational scuba diving activities
- Training programs
- Workshops and coaching
By signing this document, you confirm that you have read, understood, and agree to the terms and conditions outlined below.
1. Payments
- Full payment for all training programs is required on the first day of training, when this document is signed.
- Once training has commenced, no refunds will be issued under any circumstances.
- If a client cancels for any reason (including personal, health, scheduling, or travel-related reasons), no refunds will be issued.
- Payments are non-transferable and may not be applied to future bookings unless expressly agreed to in writing by FlowState Divers.
2. Cancellations by FlowState Divers
- If FlowState Divers cancels a scheduled activity for internal reasons (e.g., instructor availability, operational issues), clients will receive a full refund of all payments made.
- If only a portion of an activity is cancelled (e.g., part of a multi-day program), clients will receive a pro-rated refund for the cancelled portion only.
- No refunds will be issued for any portion of the activity already completed.
- FlowState Divers is not liable for additional costs incurred by the client (e.g., travel, accommodation, or personal arrangements).
3. Weather and Sea Conditions
- Scuba diving is inherently dependent on weather and sea conditions.
- Activities may be rescheduled if conditions are deemed unsafe by FlowState Divers.
- In such cases, no refunds will be issued. Rescheduling will be offered subject to instructor and operational availability.
- FlowState Divers is not responsible for adverse weather conditions or other natural events beyond our control.
4. Safety and Conduct
- FlowState Divers maintains a zero-tolerance policy toward unsafe, illegal, or irresponsible behavior.
- Any participant engaging in such behavior may be removed immediately from the activity or training program without refund.
- This includes, but is not limited to:
- Diving while under the influence of drugs, alcohol, or any impairing substance.
- Refusal to comply with professional diving standards, instructor directions, or safety protocols.
- Conduct that endangers oneself, other participants, or staff.
- Clients are expected to adhere to all international scuba diving safety standards and FlowState Divers protocols at all times.
5. Liability and Acknowledgement
- Participation in scuba diving activities carries inherent risks, including but not limited to physical injury, marine hazards, equipment malfunction, and environmental conditions.
- By signing this document, clients acknowledge that they are participating voluntarily and accept full responsibility for any risks involved.
- Clients are required to disclose any medical conditions or factors that may affect their fitness to dive prior to participation.
- FlowState Divers reserves the right to deny participation if a client is deemed medically or physically unfit to dive. In such cases, no refund will be issued once training or activities have commenced.
Acknowledgement of Agreement
By signing below, you confirm that:
- You have read and fully understood this Cancellation and Refund Policy.
- You agree to abide by its terms as a condition of participating in any FlowState Divers activity.
- You understand that this agreement is binding and enforceable under applicable law.
